Terms of Service

These Terms form a binding agreement between you and SF Bay Rental Co. By accessing, browsing, submitting information through, or otherwise using the Site, you agree to these Terms. Your continued use of the Site after any update to these Terms constitutes your acceptance of the revised Terms.

The Site is intended for users who are at least 18 years of age and able to form a legally binding contract. By using the Site, you represent and warrant that you meet these requirements and that any information you provide is true and accurate. If you are using the Site on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

The Site is an informational resource for residential leasing, rentals, and relocation services in the San Francisco Bay Area. Through the Site, you can view property listings (including listings marked as available or rented), see listing details such as rent, location, specifications, photographs, video tours, and floor plans, learn about our relocation and leasing services, explore the areas we serve, view an interactive map of listings, and submit inquiries to us.

The Site allows you to contact us, request information, request a tour or pre-qualification review for a particular property, and ask us to consider marketing or leasing your property. Submitting an inquiry or other information through the Site is a request to be contacted and does not, by itself, create any contractual, agency, brokerage, or representation relationship, and does not constitute a rental application, an offer, a reservation, or an approval or guarantee of tenancy.

We may modify, suspend, add to, or discontinue any part of the Site or its features at any time, with or without notice. We are not liable to you or any third party for doing so.

SF Bay Rental Co. is a licensed California real estate broker, California Department of Real Estate (DRE) License #01923170. Our real estate brokerage services are provided in accordance with the California Business and Professions Code, the regulations of the California Department of Real Estate, and other applicable laws.

Nothing on the Site should be interpreted as the offering of real estate brokerage services in any jurisdiction where we are not licensed to provide them.

SF Bay Rental Co. is committed to the principles of Equal Housing Opportunity and to full compliance with all applicable fair housing laws, including the federal Fair Housing Act and the California Fair Employment and Housing Act (FEHA), together with the Unruh Civil Rights Act and other applicable state and local fair housing laws.

We do not discriminate, and we do not permit discrimination, in the marketing, showing, leasing, or rental of housing on the basis of any characteristic protected by law. We welcome and serve all prospective renters, property owners, and clients, and all listings on the Site are offered on an equal opportunity basis.

Property listings and other information on the Site are provided for general informational purposes only. While we strive to keep listings current and accurate, all information is deemed reliable but is not guaranteed. Listings and Site content are provided "as is" and are subject to errors, omissions, and change at any time.

Rent amounts, deposits, availability, lease terms, specifications, square footage, and other details may change, and a property may be rented, taken off the market, or withdrawn without notice. Square footage and dimensions are approximate. Photographs, video tours, floor plans, and renderings are provided for illustration and may not reflect the current condition, features, or exact appearance of a property.

You should not rely solely on the Site in making any housing or financial decision. We encourage you to independently verify any information that is important to you, including by inspecting the property in person and reviewing the actual lease and related documents before entering into any agreement. We do not warrant that any listing is available or that any described terms remain in effect.

The content on the Site is provided for general informational purposes only and is not legal, financial, tax, accounting, insurance, or investment advice. You should consult a qualified professional regarding your specific situation before acting on any information found on the Site.

Using the Site, viewing a listing, or submitting an inquiry, application detail, or other information does not by itself create a broker-client, agency, fiduciary, or representation relationship between you and SF Bay Rental Co. Any such relationship is established only through a separate written agreement signed by us. Until then, no duty of representation arises from your use of the Site.

When you submit a contact request, a property inquiry, a tour or pre-qualification request, or a request for us to market your property, you may be asked to provide personal and, in some cases, financial information, such as your name, contact details, desired move-in date, household and occupancy details, income, and credit information. You agree to provide information that is accurate, current, and complete, and not to impersonate any person or misrepresent your identity, affiliation, or circumstances.

You are responsible for the information you submit. Providing pre-qualification or other information through the Site does not constitute a formal rental application and does not guarantee that a property is or will remain available, that you will be approved, or that a tenancy or any other agreement will result. Formal applications, screening, and leasing are handled separately and may be subject to additional terms, fees, and third-party processes.

We may use the information you submit to respond to you, evaluate and follow up on your inquiry, provide and improve our leasing and relocation services, and otherwise as described in our Privacy Policy. Please do not submit sensitive information that we have not requested.

By submitting a form, requesting information, or otherwise providing your contact details through the Site, you consent to be contacted by SF Bay Rental Co. at the email address, telephone number, and other contact details you provide. This includes communications by email, telephone call, and text or SMS message regarding property listings, tours, relocation services, your inquiry, and our related services.

Message and data rates may apply to text messages, and message frequency may vary. Consent to receive marketing or automated messages is not a condition of receiving any service from us. You may opt out of marketing communications at any time by following the unsubscribe instructions in an email, by replying "STOP" to a text message, or by contacting us using the details in the "How to Contact Us" section. Even if you opt out of marketing messages, we may still send you non-promotional messages relating to an active inquiry or transaction.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You are responsible for your conduct and for any content you submit. You agree not to engage in any of the following:

The Site and all content on it, including text, property descriptions, photographs, images, video, floor plans, graphics, logos, trademarks, service marks, trade names, page layouts, and the selection, arrangement, and compilation of that content, are owned by or licensed to SF Bay Rental Co. and are protected by United States and international copyright, trademark, and other intellectual property laws. "SF Bay Rental Co." and our logos and branding are marks of SF Bay Rental Co. and may not be used without our prior written permission.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site and to view and download content solely for your own personal, non-commercial use in evaluating our properties and services. This license does not include any right to reproduce, distribute, modify, publicly display, scrape, frame, republish, sell, or create derivative works from the Site or its content without our prior written permission. All rights not expressly granted are reserved.

The Site may contain links to, or integrate with, third-party websites, platforms, profiles, mapping tools, listing portals, and application, screening, electronic-signature, and payment services that are not owned or controlled by SF Bay Rental Co. We provide these links and references for convenience only.

We do not endorse and are not responsible for the content, products, services, accuracy, availability, privacy practices, or policies of any third party. Your use of any third-party website or service is at your own risk and is governed by that third party's own terms and policies. You should review those terms and policies before using a third-party service.

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect the information you provide, including information submitted through inquiry and contact forms. By using the Site, you consent to the data practices described in the Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding the handling of personal information, the Privacy Policy controls as to that subject.

The Site and all content, listings, and services made available through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, SF Bay Rental Co. disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that the Site or our hosting and service providers are free of viruses or other harmful components, or that any information on the Site, including any listing, is accurate, complete, reliable, current, or available. Any reliance you place on the Site or its content is at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the fullest extent permitted by California law, SF Bay Rental Co. and its owners, members, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site, any listing, or any content or services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any and all claims arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100.00). Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable California law, including liability for fraud, gross negligence, or willful misconduct. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless SF Bay Rental Co. and its owners, members, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your violation of these Terms, your violation of any applicable law or the rights of any third party, or any information you submit through the Site. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

These Terms and any dispute or claim arising out of or relating to them or to your use of the Site are governed by the laws of the State of California, without regard to its conflict of laws principles.

Before filing any claim, you agree to first contact us using the details below and to attempt in good faith to resolve the dispute informally. If we are unable to resolve a dispute within a reasonable period, you agree that the dispute will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of those courts. Any cause of action arising out of or relating to the Site must be commenced within one year after the claim arises, to the extent permitted by applicable law. Nothing in this section limits any right you may have to bring a matter before an appropriate government agency.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Changes are effective when posted to the Site. Your continued use of the Site after the changes take effect constitutes your acceptance of the revised Terms, so please review them periodically.

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of that or any other provision.

These Terms, together with the Privacy Policy and any additional terms that apply to specific services, constitute the entire agreement between you and SF Bay Rental Co. regarding the Site and supersede any prior agreements on that subject. You may not assign or transfer these Terms without our prior written consent, and any attempt to do so is void. We may assign these Terms, in whole or in part, without restriction. Section headings are for convenience only and do not affect interpretation.
